So what if I don't have a Power of Attorney?
The purpose of a Power of Attorney is to avoid the necessity of having a guardian appointing for you in the event of your incapacity. Guardianship proceedings occur in the probate court and are very involved proceedings. Once a person is appointed as your guardian, they will remain responsible for your care and/or your finances, until the court relieves them of their responsibilities. Can I prepare these Important Documents myself?
Can I just buy a form from the office store?
In today's
world it is possible to obtain forms on the internet, from hospitals,
social service agencies and office supply stores. Some are very generic
and are supposedly "good in all 49 states." However, even the forms that are specifically written in
compliance with Illinois law are much more involved than they appear. You

If you remodel your bathroom you will know if the sink is installed correctly when: 1) it doesn't fall off the wall; 2) the water comes out of the faucet; and 2) the drain pipe isn't allowing the water to flood the room. If you prepare documents with a computer program the documents may look wonderful - unfortunately - you will not know that they are leaking until you actually need to use them. At that time, it is often too late to hire an attorney to "fix" the problem with documents - it will likely require court and it will be many times more costly than if you had done it right from the start.
